This End User License Agreement (“Agreement”) is between you and Arc Social Inc. and governs your use of the Arc app (“App”) made available through the Apple App Store.

By downloading or using the App, you agree to be bound by the terms of this Agreement.

If you do not agree to this Agreement, do not use the App.

1. Scope of License

This license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the App Store Terms of Service.

2. Maintenance and Support

Arc Social Inc. is solely responsible for providing any maintenance and support services with respect to the App, as specified in this Agreement or as required under applicable law.

3. Warranty

Arc Social Inc. disclaims all warranties about the App to the fullest extent permitted by law. To the extent any warranty exists under law, Arc Social Inc., not Apple, shall be solely responsible for such warranty.

4. Product Claims

Arc Social Inc., not Apple, is responsible for addressing any claims you or any third party may have relating to the App or your possession and/or use of the App.

5. Legal Compliance

You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country.

6. Intellectual Property Rights

In the event of any third-party claim that the App infringes a third party’s intellectual property rights, Arc Social Inc., not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

7. Objectionable Content and Abuse Policy – (Arc Addendum)

Arc is a social platform built on respectful, real-world connections. By using Arc, you agree to the following additional conditions:

    •    Zero Tolerance for Objectionable Content: Any form of hate speech, harassment, bullying, impersonation, nudity, explicit content, or threats is strictly prohibited.

    •    No Abusive Behavior: Users may not harass, stalk, spam, or otherwise abuse others via the platform.

    •    User Moderation Features:

    •    Users can report objectionable behavior or content directly from within the app.

    •    Users can block other users, removing all future visibility and interactions.

    •    Content Filtering: Arc may apply automated or manual content filtering to reduce the display or spread of objectionable material.

    •    Enforcement: Arc Social Inc. reserves the right to remove any content or users who violate these policies. All valid reports will be reviewed, and appropriate action will be taken within 24 hours, including removal of content and potential suspension of the offending account.

9. Third-Party Terms of Agreement

10. Third Party Beneficiary

Apple, and Apple’s subsidiaries, are third-party beneficiaries of this Agreement. Upon your acceptance of this Agreement, Apple will have the right to enforce this Agreement against you.
